Summary of AFR Equities in FY21 NDAA Conference Report

This is all public information, it has just been consolidated in a nice reference product should any of you be interested in reviewing it.

The attached 10-page document summarizes Reserve Component equities within the Conference Report for the FY21 NDAA. This is NOT YET LAW. This marks the 60th year in a row that lawmakers will send a defense policy bill to the president’s desk, but this does not become law until the president signs the bill. AF/REI will confirm with you when this has occurred.
Lots of pertinent AFR related details are in the attachment. Of special interest:
- Authorizes AFR SELRES of 70,300 as per the President’s Budget Request
- Limits divestiture/retirement of KC-10, KC-135, U-2, RQ-4, and A-10 aircraft
- Authorizes two MILCON project at JRB Fort Worth
One was AFR requested and one was pulled forward
- Requires a minimum end strength authorization for non-temporary technicians AND NOW a separate end strength authorization for temporary dual status military technicians, to be included in the future PBRs
- Authorizes a 3% pay raise for military members
Civilian pay raises are not under the purview of the NDAA. Any such action will be in the broader federal government budget.
- Authorizes constructive credit (good year relief) for RC members restricted due to COVID-19 travel restrictions
Does not authorize Hazardous Duty Pay for those that mobilized in support of COVID-19 operations. Instead, the conferees instructed the Department to work within the Hazardous Duty Pay authorizations that exist to award this pay.
- Reverses active duty limitations on end strength for reserve general and flag officers
- Requires a SecDef report NLT March 31, 2021 with legislative recommendations on organizational structure and integration of the reserve components into the Space Force. Until report is submitted, puts in place prohibitions on establishment of a Space National Guard or Space Reserve. Further prohibits transferring any personnel of the ANG assigned to a space mission and relocation or dissolving any element of the ANG or AFR assigned to the space mission. The Conference Report does NOT include Duty Status Reform language. DoD’s proposal was not released from OMB to the Hill for inclusion. OSD has submitted the refined Duty Status Reform proposal to OMB for consideration in FY22.
